Terms of Service

Last updated: October 20, 2026

These Terms of Service ("Terms") govern your access to and use of the SecretVoice text-to-speech platform, including our website, application programming interfaces (the "API"), developer tools, documentation, generated audio, and any related services (collectively, the "Service"). By creating an account, accessing the Service, or using the API in any way, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

PLEASE READ THESE TERMS CAREFULLY. They contain important information about your rights, your obligations, the content you may generate, our right to suspend or terminate your access, limitation of our liability, and how disputes between us are resolved.

1.Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to create an account or use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the full legal capacity to enter into these Terms. You may not use the Service if we have previously suspended or terminated your account, or if you are located in a jurisdiction where the Service is unavailable or its use is prohibited by law.

2.Accounts and Credentials

You must provide accurate, current, and complete information when you create an account and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and API keys, and for all activity that occurs under your account, whether authorized by you or not. You must notify us immediately if you suspect unauthorized access to your account or credentials.

API keys are personal to your account and may not be shared, sold, leased, sublicensed, or transferred to any third party unless expressly permitted in writing by us. You are solely responsible for securing your API keys and for any use of the Service made with them. We may rotate, revoke, or refuse credentials at any time if we reasonably believe they have been compromised or misused.

3.Use of the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service, and to integrate the API into your applications, for your lawful business or personal purposes. You may not, and may not permit others to:

4.Your Content and Output

"Content" means any text, scripts, prompts, metadata, or other material you submit to the Service. "Output" means the audio, speech, and related data the Service generates in response to your Content.

You retain all rights, title, and interest in and to your Content. You are solely responsible for your Content, for the legality of the material you submit, and for how you use and distribute any Output. Except for the limited rights necessary to provide the Service (for example, to process, transmit, store, and deliver your Content and Output), we do not claim ownership of your Content or Output.

You represent and warrant that: (a) you own your Content or have all necessary rights, licenses, and consents to submit it; (b) your Content and your use of the Output do not infringe the intellectual property, privacy, publicity, or other rights of any person; and (c) your Content complies with these Terms and all applicable laws.

5.Acceptable Use and Prohibited Content

You are solely responsible for the Content you submit and the Output you generate, use, or distribute. You may use the Service only for lawful purposes and only in a manner consistent with these Terms. You must not submit Content, or use the Service to generate or distribute audio, that:

We may proactively screen Content and Output for compliance with these restrictions. Nothing in these Terms obligates us to do so, and our failure to detect a violation does not waive our rights or your obligations.

6.Fair Use and Rate Limits

The Service includes usage quotas, rate limits, concurrency limits, and other technical constraints designed to ensure fair and reliable operation for all users. You must not exceed those limits or attempt to circumvent them. We may adjust limits at any time, and may throttle, suspend, or terminate access for any user who materially exceeds them or abuses the Service.

7.Payments, Billing, and Credits

Certain features of the Service are paid. Pricing, billing units, and credit terms are described on the Service and may change from time to time. You agree to pay all fees associated with your use of the Service in the currency and by the payment method you select. Fees are generally charged in advance or on a metered basis, as described on the Service.

All fees are non-refundable except as expressly required by applicable law or as otherwise stated on the Service. If you have prepaid for credits or capacity, unused balances may expire, and are not redeemable for cash, unless otherwise stated. We may suspend or terminate your access if a payment is not received, is reversed, or is declined. You are responsible for any taxes applicable to your use of the Service, other than taxes on our income.

8.Intellectual Property

As between you and us, the Service, including its software, API, design, documentation, and the underlying speech synthesis technology and models, is owned by us or our licensors and is protected by copyright, trademark, trade secret, and other laws. You receive no ownership rights in the Service or its components. Nothing in these Terms grants you any rights to use our trademarks, trade names, or logos without our prior written consent.

Audio generated through the Service may be used within the scope of your lawful applications as permitted by these Terms. You are responsible for ensuring that your use of any Output does not violate the rights of third parties or applicable law, including rights relating to voice likeness or personality.

9.Monitoring and Enforcement

We may, but are not obligated to, monitor use of the Service for compliance with these Terms. We may investigate any suspected violation and take actions we deem appropriate, including: removing or refusing to process Content; revoking API keys; limiting, suspending, or terminating accounts; and disclosing information to law enforcement or other authorities where required or permitted by law.

Where we have a good-faith basis to believe Content or activity violates these Terms or applicable law — particularly content involving minors or any illegal activity — we may report it to the appropriate authorities without notice to you, and we will cooperate with lawful requests from those authorities.

10.Suspension and Termination

We may suspend or terminate your access to the Service, in whole or in part, at any time and for any reason, including for breach of these Terms, illegal activity, or conduct that we determine, in our sole discretion, is harmful to the Service, other users, or third parties. Where practicable and lawful, we will use reasonable efforts to provide notice, but immediate suspension or termination may occur without notice where necessary to protect the Service or comply with law.

You may terminate these Terms at any time by ceasing use of the Service and closing your account. Upon any termination or suspension, your right to access the Service ends immediately. Sections that by their nature should survive termination — including Content and Output (Section 4), Acceptable Use (Section 5), Intellectual Property (Section 8), Disclaimers, Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution — will survive.

11.Third-Party Services

The Service may depend on or integrate with third-party services, including cloud infrastructure, content delivery networks, payment processors, and inference providers. We do not control those third parties and are not responsible for their acts or omissions. Your use of any third-party service is subject to that third party's own terms and policies.

12.Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, THAT OUTPUT WILL BE ACCURATE OR FIT FOR ANY PARTICULAR PURPOSE, OR THAT THE SERVICE WILL BE SECURE, AVAILABLE, OR FREE FROM ERRORS, OUTAGES, OR LATENCY.

WE DO NOT ENDORSE, VERIFY, OR MAKE ANY REPRESENTATIONS ABOUT ANY CONTENT YOU OR OTHER USERS GENERATE THROUGH THE SERVICE. YOU BEAR ALL RISK ASSOCIATED WITH YOUR USE OF THE SERVICE AND ANY OUTPUT, INCLUDING ITS LEGALITY AND ITS SUITABILITY FOR YOUR PURPOSES.

13.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE, OUR AFFILIATES, OR OUR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US FOR USE OF THE SERVICE IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES OR LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

14.Indemnification

You agree to defend, indemnify, and hold harmless us, our affiliates, and our respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your Content; (b) your use of the Service and any Output; (c) your violation of these Terms; (d) your violation of any rights of a third party, including intellectual property, privacy, publicity, or likeness rights; or (e) your violation of any applicable law.

15.Copyright and Takedowns (DMCA)

We respect the intellectual property rights of others and expect you to do the same. If you believe that material on the Service, or content generated through the Service, infringes your copyright, you may notify us with a notice that includes: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the allegedly infringing material and where it is located; (c) your contact information; (d) a statement of good-faith belief that the use is not authorized; (e) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the rights owner; and (f) your physical or electronic signature. We will respond to valid notices in accordance with applicable law.

16.Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify you through the Service or by email. Material changes take effect on the date stated in the notice. Your continued use of the Service after the effective date of any change constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

17.Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which we are established, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration or in the courts of that jurisdiction, as provided below, and you and we each consent to the exclusive jurisdiction and venue of such courts for any dispute not subject to arbitration.

Before initiating any arbitration or legal proceeding, you agree to first contact us and attempt to resolve the dispute informally for a period of at least thirty (30) days. If the dispute is not resolved informally, it will be settled by binding arbitration administered in accordance with the applicable arbitration rules. You agree that, to the extent permitted by law, arbitration will be conducted on an individual basis and not as a class, consolidated, or representative action. You and we each waive any right to a jury trial and any right to participate in a class action, to the fullest extent permitted by law. This Section does not prevent either party from seeking injunctive or other equitable relief in court in connection with intellectual property or other claims where such relief is necessary to prevent irreparable harm.

18.Severability, Waiver, and Entire Agreement

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be deemed modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. These Terms, together with any other terms, policies, or agreements expressly incorporated by reference, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.

19.Contact

If you have questions about these Terms, you may contact us at support@secretvoice.dev. We will respond to your inquiries as promptly as we reasonably can.
